1. Acceptance of Terms

By downloading, installing, or using the EvenSteven mobile application ("App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please do not use the App. These Terms constitute a legally binding agreement between you ("User") and EvenSteven (Pty) Ltd ("we", "us", "our").

2. Eligibility

You must be at least 18 years old and a resident of South Africa to create an account and use EvenSteven. By registering, you confirm that the information you provide is accurate and complete. Registration is restricted to South African phone numbers.

3. Account Registration

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately of any unauthorised access. We strongly recommend enabling two-factor authentication (2FA) to protect your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. Services Provided

EvenSteven provides the following services through the App:

Peer-to-peer (P2P) money transfers between verified users.
Money requests — request funds from friends within the App.
EvenUp — group expense tracking, bill-splitting, and receipt scanning to help friends settle shared costs.
QR code-based friend connections and payment initiation.
Subscription plans with tiered features and usage limits.
Withdrawals to your linked bank account.
Multi-currency display across supported currencies.

We are not a bank. Funds held in your EvenSteven subaccount are managed by our payment processor, Paystack. EvenSteven acts as a facilitator of transactions and does not hold, invest, or guarantee user funds.

5. Peer-to-Peer Transfers

When you send money to another user, the transfer is processed by Paystack and is irreversible once settlement begins. You are solely responsible for verifying the recipient before confirming a transfer. EvenSteven provides an emoji verification challenge as an additional safeguard, but this does not guarantee accuracy.

Transfers sent to the wrong person cannot be reversed by EvenSteven. You must contact the recipient directly to request a return.
All transfers require explicit confirmation before execution.
Transaction amounts, fees, and recipient details are displayed on the confirmation screen — review them carefully before proceeding.

6. Money Requests

You may request money from verified friends within the App. Key terms:

Recipients are under no obligation to approve a money request.
Approving a request executes an irreversible transfer subject to the same rules as a direct send (see Section 5).
Pending requests remain actionable until the recipient approves, declines, or the sender cancels.
The optional note attached to a request is user-generated content. Notes must not contain abusive, misleading, or sensitive personal information. Violations may result in request removal or account suspension under Section 11.
Sending unsolicited, repeated, or harassing money requests is prohibited conduct under Section 11.

7. Group Expenses & EvenUp

EvenUp allows groups of users to track shared expenses, split bills, and scan receipts to calculate individual shares.

EvenSteven is a calculation and facilitation tool — it does not act as a debt collector or guarantor. We cannot compel group members to settle their balances.
Expense calculations (equal split, percentage, or custom amounts) are based on the information entered by users. EvenSteven is not responsible for errors in user-provided data.
Receipt scanning extracts item and total information automatically. Results should be reviewed for accuracy before creating an expense.
Receipt images are handled in accordance with our Privacy Policy.

8. Payments & Paystack

All payment transactions are processed by Paystack Payments Limited ("Paystack"), a licensed third-party payment processor. By using EvenSteven, you also agree to Paystack's terms of service and privacy policy.

Manual withdrawals typically settle within 1–2 business days, depending on your bank and Paystack's processing schedule.
Automatic payouts run weekly on Sunday. Settlement times depend on your bank — EvenSteven has no control over bank processing delays.
Failed transactions will be reversed, but refund timelines are subject to Paystack and your bank's policies.
Currency conversion rates and processing fees are determined by Paystack and/or your card network, not by EvenSteven.
EvenSteven does not store your full bank card details. All card information is securely tokenised and stored by Paystack in compliance with PCI-DSS standards.

9. No Storage of Banking Details

EvenSteven does not store, access, or retain your full card numbers, CVVs, PINs, or bank account passwords. Payment credentials are handled exclusively by Paystack using industry-standard encryption and tokenisation. We only store a masked reference (e.g., last four digits) for your convenience.

10. Subscription Plans

EvenSteven offers tiered subscription plans including Free, Basic (monthly and annual), and Pro (monthly and annual). Each plan has usage limits and features as described in the App.

Subscription fees are charged in advance and are non-refundable, except where required by the South African Consumer Protection Act, 2008 (CPA). If you believe you are entitled to a statutory refund, contact support@evensteven.co.za.
Plan upgrades are prorated based on your remaining billing period.
Cancellations take effect at the end of the current billing period. You will retain access to paid features until that date.
Subscriptions renew automatically unless cancelled before the renewal date.

11. Prohibited Conduct

You may not use EvenSteven to:

Engage in fraudulent, illegal, or money-laundering activities.
Circumvent security measures or access other users' accounts.
Send unsolicited, repeated, or abusive payment requests or notes.
Use the App for transactions involving prohibited goods or services.
Attempt to structure transactions to evade monitoring or reporting thresholds.
Violate any applicable South African law or regulation.

We reserve the right to report suspicious activity to the relevant authorities, including the Financial Intelligence Centre (FIC). For the full list of prohibited activities, refer to our Acceptable Use Policy available at support@evensteven.co.za or compliance@evensteven.co.za.

12. Disputes & Refunds

If you have a dispute regarding a failed or incorrect transaction, you may submit a dispute through the App. We will investigate in good faith and coordinate with Paystack where necessary.

Disputes must be submitted within 30 days of the transaction date.
You will receive updates on your dispute status within the App.
Final resolution may depend on Paystack's processes and the cooperation of the other party.
EvenSteven's determination on a dispute is final, subject to Paystack's own dispute resolution process. This does not affect your statutory rights under South African law.
EvenSteven is not liable for losses resulting from user error (e.g., sending money to the wrong person — see Section 5).

13. Limitation of Liability

To the maximum extent permitted by law, EvenSteven shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total aggregate liability is limited to the fees you have paid to EvenSteven in the preceding 12 months.

Without limiting the above, EvenSteven is not liable for:

Irreversible transfers — P2P sends and approved money requests are final once settlement begins. Misdirected payments are the sender's responsibility.
Third-party service disruptions — downtime, errors, or delays caused by Paystack, card networks, banks, or mobile carriers.
Currency conversion — exchange rates and foreign exchange fees are set by Paystack and/or your card network, not EvenSteven.
Compromised credentials — losses arising from unauthorised access to your account before you notify us. Two-factor authentication is available and strongly recommended.
Service interruption — loss of profits, business interruption, or data unavailability arising from scheduled or unscheduled downtime.
Group expense calculations — EvenUp computes balances based on user-entered data. EvenSteven does not guarantee the accuracy of user inputs, nor does it collect debts on behalf of group members.
Dispute outcomes — determinations made through our dispute process are final subject to Paystack's processes.

Nothing in these Terms limits or excludes liability that cannot be excluded under the Consumer Protection Act, 2008 or the Protection of Personal Information Act, 2013 (POPIA).

14. Intellectual Property

All content, trademarks, and intellectual property in the App belong to EvenSteven (Pty) Ltd. You may not copy, modify, distribute, or reverse-engineer any part of the App without our written consent.

15. iOS App — Apple App Store (EULA Requirements)

If you downloaded EvenSteven from the Apple App Store, the following additional terms apply. This End-User Licence Agreement (“EULA”) is concluded between EvenSteven (Pty) Ltd and you. Apple Inc. is not a party to this EULA and is not responsible for the App or its content.

1. Acknowledgement. EvenSteven (Pty) Ltd, not Apple, is solely responsible for the App and its content. This EULA is between EvenSteven (Pty) Ltd and you only, and not with Apple.

2. Scope of Licence. The licence granted is a limited, non-transferable licence to use the App on any Apple-branded product you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. Family Sharing is permitted where available.

3. Maintenance and Support. EvenSteven (Pty) Ltd is solely responsible for maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance or support services with respect to the App.

4. Warranty. EvenSteven (Pty) Ltd is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of the App’s failure to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App.

5. Product Claims. EvenSteven (Pty) Ltd, not Apple, is responsible for addressing any claims by you or any third party relating to the App, including: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

6. Intellectual Property Rights. In the event of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights, EvenSteven (Pty) Ltd, not Apple, will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

7. Legal Compliance. You represent and warrant that (i) you are not located in a country subject to a US Government embargo or designated as a “terrorist supporting” country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.

9. Third-Party Terms of Agreement. You must comply with applicable third-party terms of agreement when using the App, including your wireless data service agreement.

10. Third-Party Beneficiary. Apple and Apple’s subsidiaries are third-party beneficiaries of this EULA. Upon your acceptance, Apple will have the right to enforce this EULA against you as a third-party beneficiary thereof.

16. Notifications

EvenSteven sends push notifications to your device for transaction confirmations, payment requests, dispute updates, friend requests, and other service-related events. We may also send occasional service announcements (e.g., new features, maintenance windows).

You can disable non-essential notifications through your device's notification settings. Disabling notifications does not affect your obligations under these Terms.

17. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance. We will notify you of material changes via the App or email.

18. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be resolved in the courts of South Africa.
